WeGuide AI — Terms and Conditions

1. Who provides the service

  1. The service is provided by WeGuide AI Prosta Spółka Akcyjna (a Polish simple joint-stock company), registered office at ul. Gospodarcza 26, 20‑213 Lublin, Poland, entered in the register of entrepreneurs of the National Court Register under KRS 0001255683 by the District Court Lublin‑Wschód in Lublin seated in Świdnik, 6th Commercial Division, VAT ID (NIP) 9462770470, REGON 54529487300000, share capital PLN 7,000.00.

  3. In these Terms, "we" means WeGuide AI P.S.A. "You" means the person using the weguide.ai website or the WeGuide AI application.
  4. We are your counterparty regardless of the country you are in or the language version of the site you use. In Japan, Yamagiri G.K. (合同会社), Kyoto, is present locally as a licensee of our platform. Yamagiri G.K. is not a party to your contract, does not receive payments and does not decide about your personal data. All obligations towards you rest with us.

2. What the service is

  1. WeGuide AI is an application for travellers. It builds sightseeing routes that avoid crowds, guides you by navigation and narrates the places you pass.
  2. The guide is an artificial intelligence system, not a human being. See section 14 and the separate document "Information on the use of artificial intelligence", available on the site.
  3. The service requires access to your device's location. Without it, the service cannot be provided.
  4. The Escape the Crowd feature works without an account. By using it you accept these Terms to the extent they apply, and you are shown the artificial intelligence notice before the feature starts.

What you need for the service to work

  1. Technical requirements: a mobile device running a version of Android or iOS supported by the current release of the app, a working GPS receiver, a continuous internet connection, and audio enabled if you want voice narration. The website works in current versions of common browsers with JavaScript and strictly necessary cookies enabled.
  2. Functionality and interoperability. Content is delivered as a stream, in the app and on the site — it is not a file you download and keep on your device. We apply no technical protection measures restricting use beyond the need to sign in to an account. The content works only in our app and on our site; it is not intended for playback in other software and we do not supply it in a format that would allow that.
  3. The service requires data transmission. Data charges — including roaming outside your operator's country — are yours to pay, at your operator's rates. We have no influence over them.
  4. Battery use. Continuous GPS operation and audio playback place a heavy load on the battery. Plan for that before a long trip.

3. Who may use the service

  1. The service is available to people aged 13 and over.
  2. A person under 18 may use the service with the consent and under the supervision of a parent or legal guardian. That consent includes the guardian reading these Terms.
  3. Purchases may be made by an adult, or by a minor with the guardian's consent. By confirming a purchase you declare that you have full legal capacity or that you have the guardian's consent. If a guardian refuses to confirm a contract made by a minor, we refund the full amount paid.

4. Your account

  1. Most features require an account. You create one by providing your first name, e‑mail address, country and preferences, or by signing in through an external identity provider.
  2. The information you give at registration should be true and kept up to date.
  3. You are responsible for keeping your login credentials confidential. If you suspect someone has obtained them, write to desk@weguide.ai and we will secure the account immediately.
  4. You can delete your account at any time — the option is at the bottom of the profile screen and requires password confirmation. What is deleted and what is kept is set out in the privacy policy.

5. Plans and prices

  1. The service is offered in three plans:

  1. Seven days is the only period offered for a paid plan. We do not offer monthly or annual plans.
  2. We do not use auto-renewing subscriptions. A plan does not renew itself and we do not take further payments without your decision. After 7 days you return to the FREE plan.
  3. All prices are stated in US dollars (USD) and include applicable taxes. If your bank or payment provider converts the amount into another currency, it does so on its own terms and at its own exchange rate — we do not operate a currency converter and have no influence over the rate or your bank's charges.
  4. The current price list — plan prices, credit allowances and the credit cost of each feature — is published on the site and in the app. The price list in force at the moment of purchase forms part of the contract.
  5. A change in the price list does not affect purchases already made. Credits and plans bought earlier are settled at the rates applicable when you bought them.
  6. If we make purchases available through an app store in the future, the store price will be higher than the price on our site by the amount of the store operator's commission. We state this explicitly next to every such price. Which channel you use is your choice.
  7. We do not use personalised pricing. The price you see is not tailored to you on the basis of your data or your behaviour. Every user sees the same price within a given sales channel.

6. Credits

  1. A credit is a unit of account entitling you to activate a feature in accordance with the price list. A credit is not money, electronic money or a means of payment, cannot be exchanged for cash and cannot be used to pay third parties. It can only be used within our service.
  2. Your plan allowance renews every 7 days. Unused plan credits expire at the end of the period and do not carry over.
  3. Purchased credits are valid for 12 months from the date of purchase. Expiry of a plan does not affect them — they stay in your balance for their full validity period.
  4. Spending order: we always use plan credits first and purchased credits only once the allowance is exhausted. That way the credits that would expire anyway are used first.
  5. Buying credits works through a slider in steps of 5 credits. The unit price falls with every 20 credits, and the discount applies marginally — the lower rate applies only to credits above the relevant threshold, not to the whole order. The total price is always shown before you confirm, and never decreases when you increase the number of credits.
  6. A feature paid for with credits runs until the end of your trip, not until midnight.
  7. We charge no credits for regenerating the same route on the same day, or for recalculating a saved route when you start it.
  8. Information about the 12‑month validity of purchased credits, the renewal and expiry of the plan allowance and the spending order is also shown next to the purchase slider, before you confirm.

7. Signature routes

  1. In addition to plans, we offer individual signature routes. Buying a route is a separate contract.
  2. A signature route does not expire. It is consumed by activation; once used it stays in your account marked as used and you can start it again — with voice narration at the full daily voice rate, or with navigation only.
  3. There are two kinds of signature route: - WeGuide's own routes — we are responsible for their content; - routes by external creators — prepared by authors working with us. We sell them in our own name and we are your counterparty, but the creator is responsible for the substance of the route; we are responsible for delivering it, for its working and for its matching the description.
  4. In signature routes the narration may be played in the creator's voice reproduced synthetically (a voice clone), with their consent. If a creator withdraws consent to the use of their voice, the route may cease to be available in that voice version.
  5. If a route you have bought stops working or loses a feature you paid for — for any reason on our side or the creator's — you may require us to bring it into conformity, and if that is not possible: a price reduction or a refund of the amount paid. Write to desk@weguide.ai.

8. Group trips

  1. We plan to introduce group trips. Until the feature is launched it is neither offered nor sold. The rules below take effect on the day it becomes available.
  2. How it works: one person buys a number of accesses and invites participants by e‑mail. A participant joins after creating their own free account.
  3. Each participant enters into their own contract with us — they accept these Terms personally when creating an account. The buyer does not act on their behalf; the buyer acquires access and passes on the entitlement.
  4. All participants follow the same route, but each receives their own narration, matched to their interests. We select the route so that it best fits the preferences of the whole group — which means one participant's interests influence the others' experience. The privacy policy in force on the launch date will describe this processing.
  5. We process an invited person's e‑mail address solely to deliver the invitation and delete it after 30 days at the latest if the invitation is not used.

9. Contract formation and payment

  1. The contract is concluded when you confirm your order and the payment is successfully made.
  2. Before you confirm, we show you: what you are buying, the total price in USD, the period, and — for credits — their number and validity period.
  3. Payments are handled by an external payment provider. We do not store your full card details.
  4. We issue a sales document on request. Write to desk@weguide.ai.

10. Right of withdrawal

This section describes your statutory right. Separately and in addition, you have the broader contractual guarantee in section 11.

  1. As a consumer you have the right to withdraw from the contract within 14 days of concluding it, without giving a reason and without incurring costs.
  2. To withdraw, it is enough to send a statement to desk@weguide.ai before the deadline. You may use the form attached to these Terms, but you do not have to.
  3. When the right of withdrawal is lost. Our services consist in supplying digital content not on a tangible medium, and we make it available immediately after purchase. That is why, at checkout, we ask for two separate confirmations: - your express consent to performance beginning before the withdrawal period ends, and - your acknowledgement that you will lose the right of withdrawal once performance begins.

Giving both confirmations is a condition of making the purchase — without them we could not make the service available immediately, which is the essence of what you are buying. If you do not wish to give them, simply do not make the purchase; you then keep the full right of withdrawal. We send you an e‑mail confirming the consents you gave promptly after purchase.

  1. If you withdraw, we refund the full amount promptly and no later than within 14 days, using the same payment method you used.
  2. Losing the right of withdrawal does not affect the guarantee in section 11. In practice this means you can get your money back even after you start using the service — on terms better than the statutory minimum.

11. 30-day money-back guarantee

  1. We refund your money within 30 days of purchase, no questions asked.
  2. The guarantee covers every purchase route: plans, purchased credits and signature routes. Promotions and special offers are not excluded.
  3. The refund covers the full amount paid, including where some credits have already been used. We do not calculate proportions and we do not ask how much you used.
  4. Effect of a refund: credits from the refunded purchase are removed from your balance, the plan expires and the account returns to the FREE plan. A refunded signature route ceases to be available.
  5. Write to desk@weguide.ai with your account e‑mail and the purchase date. We reply within 14 days and pay out promptly once the request is accepted.
  6. Abuse. We may refuse a refund only where the circumstances clearly show that purchases and refunds are being repeated in order to use the service for free. Any refusal must identify the specific circumstances and can be appealed. A single refund is never an abuse.
  7. If you buy through an app store, the store operator processes refunds under its own rules and you should apply to them. We have no influence over their decision or timing. If they refuse and your request would have fallen within our guarantee, write to us and we will handle it on our side.

12. Conformity of the service and complaints

  1. We must supply a service in conformity with the contract: working as described, of the quantity and quality that can reasonably be expected, together with the updates needed to keep it in conformity.
  2. If the service is not in conformity, you may require us to bring it into conformity. If we fail to do so within a reasonable time, if it is impossible, or if it would cause you significant inconvenience, you may require a price reduction or withdraw from the contract; where the lack of conformity is material, you may withdraw immediately.
  3. Complaints go to desk@weguide.ai. Include your account e‑mail, a description of the problem and, if you can, the date and time. We reply within 14 days of receiving the complaint.
  4. These rights apply independently of the guarantee in section 11 and are not limited by it.
  5. Out-of-court dispute resolution. As a consumer you may use out-of-court complaint and redress procedures. In Poland these include the regional Trade Inspection Authority and the permanent consumer arbitration court operating alongside it, as well as municipal and district consumer ombudsmen. If you live elsewhere, equivalent bodies may be available in your country. Using them is voluntary.

13. Your content

  1. You may add your own content to the service — reviews, ratings, photos, comments.
  2. By adding content you confirm that you hold the rights to it and that it infringes neither third-party rights nor the law.
  3. You do not transfer copyright in your content to us — it stays yours. You grant us only a non-exclusive, royalty-free licence to use it as needed to operate and promote the service: to reproduce it, make it publicly available in the site and the app, translate it and adapt it technically. The licence includes the right to have our suppliers carry out those acts.
  4. You can withdraw the licence at any time by deleting the content. We will remove it promptly; if it was previously used in materials already distributed, the withdrawal does not act retroactively on those materials.
  5. We do not ask you to waive your moral rights — such a waiver would in any event be ineffective under the applicable law.
  6. Remember that photos can carry hidden file data, including where and when they were taken. If you do not want to share that, remove it before uploading.
  7. Reviews and ratings — what we do not know about them. Any person with an account can post a review. We do not check whether the author actually walked the route or visited the place the review concerns. We say so plainly, so that you know what weight to give them. We do not commission reviews, we do not pay for them, and we do not remove negative reviews because they are negative. We remove only content breaching section 16.2, giving the reason in accordance with section 16.4.

14. Artificial intelligence

  1. The WeGuide guide is an artificial intelligence system. You are talking to a program, not a person.
  2. The following are generated automatically: route selection, the order of places, narration content and answers to your questions. The voice narration is synthetic audio, machine-generated. In signature routes it may be a synthetic reproduction of the creator's voice, used with their consent.
  3. Generated content can contain errors. Critical information — opening hours, ticket prices and availability, entry rules, safety notices — should be verified at the source before you rely on it.
  4. You are moving through real streets and you are responsible for your own safety. A route is a suggestion, not an instruction. Do not enter anywhere that looks unsafe or off-limits, whatever the app suggests.
  5. The system makes no decisions producing legal effects concerning you or similarly significantly affecting you.
  6. The guide does not sell to you. Commercial messages appear only as clearly marked interludes, separated from the narration; the guide never urges you to buy a plan or top up credits.
  7. We show the artificial intelligence notice at first launch of the app and before Escape the Crowd starts — including when you use it without an account.
  8. How data from your conversation with the guide is processed is set out in the privacy policy. We do not use your data to train artificial intelligence models.

15. Our liability

  1. We are liable for non-performance and improper performance of the contract on the terms laid down by law. We do not exclude or limit liability for personal injury, for damage caused intentionally, or in any other case where the law prohibits it.
  2. We are also liable for errors of the AI guide — within the limits under paragraph 1 and taking into account that we expressly warned you to verify critical information (section 14.3) and that you are responsible for your own safety on the ground (section 14.4).
  3. We are not liable for the acts or omissions of third parties whose services or premises you visit — museums, carriers, venues, operators. We are not a party to your contracts with them.
  4. We work to keep the service running without interruption, but we do not guarantee uninterrupted availability. Where possible, we give advance notice of planned maintenance.

16. Rules of use and content moderation

  1. When using the service you must not: break the law, impersonate others, disrupt the service, harvest data by automated means without our consent, circumvent security measures, resell access, or share your account with third parties.
  2. You must not publish unlawful content, in particular content infringing others' rights, inciting violence or hatred, or misleading others about places and services.
  3. Reporting content. Anyone can report content they consider unlawful by writing to desk@weguide.ai. Describe the content, say where it is and explain why you consider it unlawful. We handle reports without undue delay and in an objective manner.
  4. Reasons for decisions. If we remove your content, restrict its visibility or suspend your account, we will tell you and give the reason, identifying the rule breached or the legal basis. You can appeal any such decision by writing to desk@weguide.ai; the appeal is handled by someone other than the person who took the original decision.
  5. We may suspend or delete an account for serious or persistent breaches of these Terms. Suspension or deletion does not deprive you of the right to a refund for anything you paid for and did not receive.

17. Changes to these Terms

  1. We may change these Terms for good reasons: changes in the law, changes in the scope or manner of the service, security, changes in how payments are settled, or the need to remove ambiguity.
  2. We will notify you by e‑mail and in the app at least 14 days before a change takes effect, stating what is changing.
  3. If you do not accept a change, you may terminate the contract with immediate effect before it takes effect, at no cost. We then refund the proportionate part of the plan fee for the unused period and the value of unused purchased credits.
  4. Changes do not apply to services already purchased. Those are settled on the terms in force when you bought them.

18. Governing law, courts, language

  1. These Terms are governed by Polish law.
  2. The choice of Polish law does not deprive you of the protection afforded by the mandatory provisions of the law of the country where you have your habitual residence. Where that law protects you more strongly, it applies.
  3. We do not impose a court on you. Disputes are heard by the courts having jurisdiction under the applicable rules; as a consumer you may sue us in the courts of your place of residence. You do not waive any right to take part in collective or representative actions, and we do not shorten the limitation periods applicable to your claims.
  4. These Terms are published in Polish and in English. For consumers habitually resident in Poland the Polish version is binding; for everyone else, the English version. In case of divergence, the version binding for you prevails, and doubts are resolved in your favour.
  5. If any provision of these Terms is invalid or ineffective, the remainder continues to apply.
  6. Nothing in these Terms limits consumer rights arising from mandatory law. In case of conflict, those provisions prevail.

19. Personal data

How we process personal data is set out in the privacy policy, available on the site. The controller is WeGuide AI P.S.A.

20. Entry into force

These Terms apply from 1 September 2026 and replace the Terms and Conditions of 20 March 2026.
